Bengaluru: HC to look into validity of remote consultation | Bengaluru News – Times of India

BENGALURU: The high court on Wednesday passed an interim order directing that no further steps should be taken even if the final environment impact assessment ( EIA) report is filed on the construction of the eight-lane peripheral ring road project, phase 1.
A division bench heade

d by chief justice Abhay Shreeniwas Oka passed this order after hearing a PIL filed by three law students, one each from Bengaluru, Ghaziabad and Delhi. The bench, however, declined to pass any order to stall the public consultation proceedings, which commenced on Wednesday.

The court also ordered notice to the KSPCB and BDA, while observing that whether virtual hearing through Zoom platform can be a valid public hearing needs to be looked into.
The petitioners contended that public consultation is being held in virtual format and the same is not in consonance with the EIA notification dated September 14, 2006, which contemplates public hearing at the site or at close proximity with the affected persons.
